Special Judge Chamba H.P.,July 2002,Hon'ble High Court of Himachal Pradesh has been pleased to allow the revision petition and the order dated 4-1-2005 passed by Ld. Special Judge Chamba in case No.2 of 2002 directing the framing of charges against the deponent and the co-accused is set aside and the charges framed against them are quashed vide order in Criminal Revision No.20 of 2005 dated 29th April, 2005. The case is remanded and transferred from the court of Ld. Special Judge Chamba to the Court of Ld. Special Judge, Kangra at Dhararnshala with the directions to proceed in the matter in accordance with the provisions of section 239 and 240 of the Code of Criminal Procedure and dispose of the case in accordance with law keeping in view the provisions of Article 22(1) of the Constitution. Now the matter is pending before the Hon'ble Supreme Court of India in case titled Ashish Chadha Vs Smt. Asha Kumari and ors in Special Leave Petition (Crl) No. 5922 of 2005 in appeal No. 893 of 2005 and Hon' ble Supreme Court vide order dated 18-7-2005 has ordered the stay of the operation of impugned judgment in the meanwhile.
